1. Agreement to Terms

By accessing or using the GuavaTex website, located at https://guavatex.com/, and any services provided by us (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

GuavaTex provides an online platform that connects customers ("Clients") with businesses and service providers ("Professionals") to schedule appointments. GuavaTex acts as a neutral intermediary. We are not a party to any agreement between Clients and Professionals and are not responsible for the quality, safety, or legality of the services provided by the Professionals.

3. User Accounts

To use certain features of the Service, you may be required to create an account. You must provide accurate and complete information. You are solely responsible for the activity that occurs on your account and for keeping your account password secure. You must be at least 18 years of age to create an account.

4. Payments, Cancellations, and Refunds

Some services offered by Professionals may require payment. By scheduling a paid appointment, you agree to pay all applicable fees. All cancellation and refund policies are established and managed by the individual Professional, not by GuavaTex. Any disputes regarding payments, refunds, or cancellations must be resolved directly between the Client and the Professional.

5. SMS/Text Messaging Services

As part of the Service, you may receive transactional SMS/text messages from GuavaTex (e.g., appointment confirmations and reminders). By creating an account and using the Service, you agree to receive these communications. You can opt-out of receiving SMS messages at any time by following the instructions in our Privacy Policy. Please note that opting out of messages may impact your use of the Service. Message and data rates may apply.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose or to engage in any of the following prohibited activities:

Harassing, threatening, or defrauding other users.
Posting false, inaccurate, misleading, defamatory, or libelous content.
Distributing viruses or any other technologies that may harm GuavaTex or its users.
Attempting to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes the quality of, or interferes with the performance of the Service.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Disclaimer of Warranties

Important Notice: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. GuavaTex makes no warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.

9. Limitation of Liability

In no event shall GuavaTex, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) any conduct or content of any third party on the Service, including any services rendered by a Professional; (iii) any content obtained from the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Hampshire, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page and updating the "Last Updated" date.
